1. Agreement to Terms

By accessing or using TipFort ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

TipFort is a software-as-a-service (SaaS) platform that helps employers in tipped industries track tips and overtime, calculate FLSA overtime premiums, monitor OBBBA deduction caps, and generate W-2 Box 12/14b data exports compatible with major payroll systems.

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription and Billing

The Service is currently offered free of charge during our early access period. No payment information is required to use the Service during this period. When paid plans are introduced, you will be notified in advance and given the option to subscribe. You may cancel at any time; access continues through the end of the current billing period. 5. User Obligations

You are solely responsible for the accuracy of data entered into the Service. TipFort provides calculation tools and export formatting but does not provide tax, legal, or accounting advice. You should consult qualified professionals for compliance guidance specific to your situation.

6. Data Ownership

You retain ownership of all data you enter into the Service. We do not claim any intellectual property rights over your content. Upon account termination, your data will be preserved in read-only mode for a reasonable period to allow export.

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind. TipFort shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless TipFort and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

9. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days prior to taking effect. Continued use after changes constitutes acceptance of the updated terms.

10. Termination

We may suspend or terminate your access if you violate these Terms or engage in conduct that harms the Service or other users. You may terminate your account at any time from the Settings page.

11. Governing Law

These Terms shall be governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with applicable rules.
